It is issued by EdinPro Digital Ltd, trading as GarageCloud ("GarageCloud", "we", "us"), a company registered in Scotland under company number SC906556, registered office 11 Muir Place, Livingston, EH54 5BF.
1.2 It forms part of our Terms of Service and applies to garages holding an Account, their Authorised Users, and End Customers using the Customer Portal. Garages are responsible for making sure their Authorised Users follow it.
2. Content you must not upload or send
2.1 You must not use the Service to store, share or send anything that:
is unlawful, fraudulent, defamatory, threatening, abusive, obscene or hateful;
infringes anyone's copyright, trade marks or other rights;
contains personal data you have no lawful basis to hold;
contains viruses, malware or other harmful code; or
is intended to mislead anyone.
3. Records and documents
3.1 You must not use the Service to create or keep false or misleading records, including:
invoices, quotes or job records for work not done or parts not fitted;
false mileage records or any record that helps disguise a vehicle's true mileage;
false or altered MOT, inspection or service history information; or
documents that impersonate another business.
4. Messages to customers
4.1 When you send emails or text messages through the Service you must:
have consent for marketing messages where the Privacy and Electronic Communications Regulations 2003 require it;
identify your business clearly and include a simple way to opt out of marketing;
act promptly on opt out requests; and
not send spam, bulk unsolicited messages or messages using a false sender name or number.
5. Security and system misuse
5.1 You must not:
try to access another garage's Account, data or Subdomain;
probe, scan or test the Service for weaknesses without our written permission;
get round any security measure, usage limit or access control;
share login details or let people outside your business use your Account;
scrape or bulk extract data, including DVSA Data, other than through our export tools or APIs;
copy, decompile or reverse engineer the Service except where the law allows despite this restriction; or
use the Service in a way that overloads or disrupts it for other customers.
6. AI features
6.1 You must use AI features in line with the AI Features Policy. In particular, you must not present an AI output to a customer as a confirmed diagnosis without checking it, or use AI features to produce misleading content.
7. Fair usage
7.1 There are currently no usage limits on any Plan. If we introduce limits, we will give at least 30 days' notice under the Terms of Service.
7.2 If your use is well above normal for your Plan, we will contact you first to discuss an upgrade or other solution before taking any action.
8. Reporting misuse
8.1 If you see anything that breaches this policy, including a security weakness, please report it to [email protected]. Please do not test or exploit a weakness yourself.
9. What we may do
9.1 If we reasonably believe this policy has been breached, we may do one or more of the following, acting proportionately:
contact you and ask you to stop or put things right;
remove or disable access to the content concerned;
suspend access under clause 18 of the Terms of Service;
end your subscription under clause 19 of the Terms of Service; and
report the matter to the police, Trading Standards, the ICO or another authority where appropriate.
9.2 Where reasonably possible we will warn you and give you a chance to fix the issue first, unless the breach is serious, unlawful or puts other customers at risk.
10. Changes
10.1 We may update this policy. Material changes will be made in the same way as changes to the Terms of Service under clause 25.
